YeWalaGhar.com — Terms & Conditions for Property Owners

1. Definitions

  • "YeWalaGhar / We / Us / Platform" refers to YeWalaGhar.com, operated by Grenoverse Multi Ventures LLP, registered in Greater Noida, Uttar Pradesh, India.
  • "Owner / You / Property Provider" refers to the lawful owner of the property or a duly authorized representative acting on behalf of the legal owner.
  • "Tenant" means any prospective or final tenant introduced, matched, or facilitated by YeWalaGhar through any medium.
  • "Introduced Tenant" means any tenant whose details, visit, inquiry, negotiation, or interaction is initiated, shared, or coordinated by YeWalaGhar — through website forms, WhatsApp, calls, emails, visit schedules, or any official communication record — within 120 days of first introduction.
  • "Standard Listing" refers to the free listing service available to all Owners at zero cost and with zero brokerage obligation at any stage.
  • "Fast-Track Listing" refers to an optional, exclusively owner-initiated premium listing service offering priority placement and faster tenant matching, subject to a success-based brokerage.
  • "Brokerage / Service Fee" means the fee payable to YeWalaGhar strictly and only by Owners who have explicitly opted for the Fast-Track Listing plan, payable solely upon successful deal closure.
  • "Deal Closure / Successful Transaction" means the execution of a signed Rent Agreement between the Owner and a YeWalaGhar-introduced Tenant, confirmed with possession handover.
  • "KYC" means Know Your Customer — the identity and document verification process conducted by YeWalaGhar.
  • "Force Majeure" means any event beyond reasonable control including natural disasters, pandemics, government orders, regulatory restrictions, or acts of God.
  • "Digital Consent" means valid electronic acceptance provided through website checkbox or WhatsApp confirmation, recognized under the Information Technology Act, 2000.
  • "DPDP Act" means the Digital Personal Data Protection Act, 2023.

2. Nature & Scope of Platform

  1. YeWalaGhar.com is strictly a technology-based property listing and facilitation platform connecting property owners with prospective tenants.
  2. YeWalaGhar is not a real estate broker, agent, landlord, co-landlord, or party to any rental transaction, agreement, or tenancy relationship.
  3. YeWalaGhar does not own, manage, operate, control, or take responsibility for any property listed on the platform.
  4. The platform solely provides a digital medium for Owners and Tenants to discover each other and initiate a rental relationship.
  5. All final decisions regarding tenancy — including but not limited to tenant selection, rent negotiation, agreement terms, and possession — rest solely and exclusively with the Owner and the Tenant.
  6. YeWalaGhar's role is limited to facilitation only. Any obligation, liability, or relationship arising after facilitation is strictly between the Owner and the Tenant, and YeWalaGhar shall have no part therein.

3. Listing & Onboarding

  1. Owners must provide accurate, complete, and truthful information at the time of listing, including but not limited to: monthly rent, maintenance charges, security deposit, availability date, property type, furnishing status, amenities, and photographs.
  2. YeWalaGhar reserves the right to reject, modify, pause, or permanently remove any listing that contains misleading, false, incomplete, or unverifiable information, at its sole discretion.
  3. The Owner confirms that they are the legal owner or a duly authorized representative and may be required to submit valid ownership or authorization proof at any point during the listing or deal process.
  4. YeWalaGhar reserves the right to conduct independent verification of any listing or owner identity at its discretion, without prior notice.
  5. Submission of a listing on YeWalaGhar.com constitutes the Owner's agreement to all terms and conditions stated herein.

4. Listing Accuracy & Availability Disclaimer

  1. YeWalaGhar.com is a live listing platform. All properties displayed on the platform are not guaranteed to be real-time verified available properties.
  2. The availability, condition, rent amount, and listing details of any property reflect information provided at the time of listing only and may change at any time without prior notice.
  3. Any listed property may be:
    • Already rented — where the Owner has not updated the listing status
    • Temporarily unavailable due to Owner's personal decision
    • Under active negotiation with another prospective Tenant
    • Placed on hold by the Owner
    • Subject to revised rent or terms after the listing was published
  4. YeWalaGhar does not guarantee the real-time availability of any property listed on the platform.
  5. YeWalaGhar shall not be held liable for any loss, inconvenience, wasted effort, or disappointment arising from inaccurate, outdated, or unavailable property listings.
  6. It is the Owner's sole responsibility to keep their listing updated at all times. Any loss, dispute, or inconvenience caused to a Tenant or to YeWalaGhar due to an outdated or inaccurate listing shall be the Owner's sole responsibility.
  7. Repeated failure to update listing status may result in listing suspension or permanent removal from the platform.

5. Mandatory Property Ownership Declaration

By listing a property on YeWalaGhar.com, the Owner irrevocably declares, represents, and warrants that:

  1. The property being listed is their own legal property with full and undisputed ownership rights — OR they hold valid written authorization (such as a registered Power of Attorney or written consent) from the actual owner to list, lease, or sublease the property.
  2. The Owner has full legal authority to rent, lease, or sublease the said property under all applicable laws and regulations.
  3. The property is completely free from all ownership disputes, legal encumbrances, court orders, mortgage defaults, attachment orders, injunctions, or any third-party claims that may adversely affect tenancy.
  4. The property complies with all local municipal, government, and regulatory requirements applicable to residential rental use.
  5. Rental activity is permitted within the applicable Resident Welfare Association (RWA), society, housing authority, or any governing body rules and bye-laws.
  6. No court injunction, stay order, government prohibition, or legal restriction exists against the use, occupation, or rental of the property.
  7. The property is not under any mortgage, hypothecation, or lien that restricts or prohibits its rental or occupation by a third party.
  8. Any false, misleading, or incomplete ownership declaration shall make the Owner solely and fully liable for all resulting legal, civil, financial, and criminal consequences.
  9. YeWalaGhar is fully, unconditionally, and permanently indemnified from any consequence, claim, or liability arising from false or misleading ownership declarations.
  10. YeWalaGhar reserves the right to demand valid ownership proof — including sale deed, registry copy, allotment letter, Power of Attorney, or any government-issued property document — at any time.
  11. Listing a property without valid legal ownership or written authorization shall be treated as fraudulent misrepresentation under the Indian Penal Code and the Information Technology Act, 2000, and may result in immediate delisting, permanent ban from the platform, and initiation of legal proceedings.

6. Society / RWA / Housing Authority Compliance

  1. The Owner declares that the rental of the listed property is expressly permitted by the applicable Resident Welfare Association (RWA), society, housing authority, builder, or any other governing body.
  2. The Owner is solely responsible for obtaining all necessary permissions, No Objection Certificates (NOCs), or approvals required for renting the property under applicable society, municipal, or government rules.
  3. YeWalaGhar shall not be held liable for any disputes, fines, penalties, eviction notices, or legal action arising from violation of society, RWA, or housing authority rules.
  4. If rental is subsequently found to be prohibited or restricted by the society or RWA, the Owner shall bear full responsibility and shall indemnify YeWalaGhar from any and all consequences arising therefrom.
  5. YeWalaGhar does not verify society or RWA rental permissions independently and relies entirely and exclusively on the Owner's declaration made herein.

7. KYC & Identity Verification

  1. YeWalaGhar may conduct basic KYC (identity verification) of Owners as part of the listing onboarding process.
  2. The Owner must provide valid government-issued identity proof — including but not limited to Aadhaar, PAN, Passport, or Voter ID — when requested by YeWalaGhar.
  3. KYC verification by YeWalaGhar is a process-level check only and does not constitute legal validation of ownership status, property title, or any other legal matter.
  4. YeWalaGhar shall not be held responsible or liable for any fraud committed by an Owner who has passed basic KYC verification, as KYC is a screening process and not a legal guarantee.
  5. All KYC data shall be handled in strict accordance with applicable data protection laws, including the DPDP Act, 2023, and used solely for verification and compliance purposes.

8. Police Verification & Tenant Documentation

  1. The Owner is solely and exclusively responsible for ensuring that Police Verification of the Tenant is initiated and completed before or immediately after possession of the property.
  2. YeWalaGhar may provide guidance, documentation templates, or procedural assistance for Police Verification but is not responsible for initiating, completing, following up on, or ensuring Police Verification.
  3. Any legal consequence, liability, or action arising from failure to conduct Police Verification shall be the Owner's sole and exclusive responsibility.
  4. The Owner must independently verify all Tenant documents — including government-issued identity proof, employment or income documents, and personal references — before executing the Rent Agreement.
  5. YeWalaGhar provides pre-screened tenant leads based on basic profile-level checks only and does not guarantee the authenticity, background, character, conduct, or financial capacity of any Tenant. Final verification responsibility rests with the Owner.

9. Listing Plans & Fees

9.1 Standard (Free) Listing:

  • Zero upfront cost at listing stage
  • Zero brokerage at any stage — regardless of deal outcome
  • Basic visibility on the platform
  • YeWalaGhar will actively assist in tenant matching and facilitation
  • The Owner has absolutely no financial obligation of any kind to YeWalaGhar under this plan, at any point

9.2 Fast-Track Listing (Optional — Strictly Owner's Voluntary Choice):

  • A completely voluntary, opt-in service — chosen explicitly by the Owner either at the time of listing or at any point thereafter
  • Must be opted in through explicit confirmation via website selection, WhatsApp confirmation, or written request — no implicit, assumed, or verbal enrollment is valid
  • Offers priority placement, faster tenant matching, and enhanced visibility across the platform
  • Brokerage = 10 days' rent calculated on the finalized agreed monthly rent amount
  • Brokerage is payable only and strictly after successful deal closure — defined as execution of signed Rent Agreement with confirmed possession handover
  • If the property is not rented, no brokerage is charged — Fast-Track is a completely success-based service
  • If the Owner opts for Fast-Track and subsequently withdraws before deal closure, no brokerage shall be charged provided no Introduced Tenant has been finalized

9.3 Critical Clarification — Standard vs. Fast-Track:

  • YeWalaGhar will under no circumstances, at any stage, for any reason charge any brokerage, fee, commission, or payment from a Standard listing Owner
  • Standard listing Owners have absolute zero financial liability to YeWalaGhar
  • No implicit, verbal, or assumed Fast-Track enrollment is valid — explicit written or digital opt-in is mandatory
  • The distinction between Standard and Fast-Track enrollment shall be maintained in YeWalaGhar's internal records and shall be available as evidence in case of any dispute

9.4 Non-Payment (Applicable to Fast-Track Owners Only):

If an Owner who has explicitly opted for Fast-Track fails to pay the applicable brokerage within 15 days of invoice issuance following successful deal closure, YeWalaGhar reserves the right to:

  • Immediately suspend all services for that Owner
  • Delist all active and future properties of that Owner
  • Initiate recovery proceedings for outstanding brokerage amount
  • Charge applicable interest on delayed payments as per law
  • Initiate appropriate legal action including recovery of brokerage, interest, penalties, and all legal costs

10. Exclusivity & Anti-Bypass Policy

  1. Any tenant whose details, profile, visit, inquiry, negotiation, or any interaction has been initiated, shared, or coordinated by YeWalaGhar shall be considered an "Introduced Tenant" — regardless of how or through whom the final rental agreement is ultimately executed.
  2. The anti-bypass protection applies to all Introduced Tenants within 120 days of the date of first introduction by YeWalaGhar.
  3. Fast-Track Owners who rent or agree to rent their property to an Introduced Tenant — directly, indirectly, or through any third party — without routing and completing the transaction through YeWalaGhar shall be liable to pay the full Fast-Track brokerage (10 days' rent) to YeWalaGhar.
  4. Standard listing Owners are not subject to brokerage obligations but remain fully bound by all platform conduct, usage, and behavioral terms stated herein.
  5. The following shall constitute valid and sufficient legal proof of introduction by YeWalaGhar:
    • WhatsApp chat records and screenshots
    • Property visit confirmations and schedules
    • Tenant application and requirement forms
    • Call logs and telephonic records
    • Email communications
    • Internal CRM and platform visit records
  6. Attempted or successful bypass shall result in:
    • Legal recovery of full applicable brokerage
    • Additional penalties and interest as applicable
    • Immediate and permanent delisting from the platform
    • Initiation of legal proceedings for recovery of all costs

11. Property Condition & Site Visits

  1. The property must be clean, safe, habitable, and ready for occupation at the time of all scheduled site visits.
  2. Basic utilities including water supply and electricity connection must be fully functional at the time of visits.
  3. The Owner or their duly authorized representative must be personally available for all visits scheduled by YeWalaGhar.
  4. Misrepresentation of property condition — including but not limited to misleading photographs, false amenity claims, or concealment of structural issues — may result in immediate listing suspension, penalties, and liability for any consequential loss suffered by the Tenant.
  5. YeWalaGhar is not responsible for any accident, injury, loss, or incident occurring during a property visit. Owner is responsible for ensuring the property is safe for visits.
  6. Owners must provide reasonable notice if they need to reschedule or cancel a confirmed visit. Repeated cancellations without valid reason may result in listing suspension.

12. Tenant Selection

  1. YeWalaGhar provides pre-screened tenant leads based on basic profile-level checks only. This does not constitute a guarantee of any kind regarding tenant authenticity, conduct, or reliability.
  2. Final tenant selection rests solely, exclusively, and entirely with the Owner. YeWalaGhar does not impose, recommend, or guarantee any specific tenant.
  3. The Owner must independently verify all tenant documents, references, and credentials before executing the Rent Agreement.
  4. YeWalaGhar bears no responsibility whatsoever for the conduct, behavior, financial capacity, or actions of any Tenant — whether during the tenancy or after.
  5. Owners are strongly advised to not hand over possession without a properly executed Rent Agreement and initiated Police Verification.

13. Brokerage & Payment Terms (Fast-Track Owners Only)

  1. Brokerage becomes payable only upon successful execution of the Rent Agreement and confirmed possession handover, under the Fast-Track plan exclusively.
  2. YeWalaGhar will issue a formal invoice within 7 working days of deal closure confirmation.
  3. Payment must be made within 15 days of invoice issuance, unless otherwise agreed in writing by YeWalaGhar.
  4. Accepted payment modes: UPI, bank transfer, or any other authorized digital payment method officially communicated by YeWalaGhar.
  5. All applicable GST or government taxes shall be charged additionally as per prevailing tax laws, unless explicitly stated otherwise at the time of opt-in.
  6. Late payments shall attract interest at the rate of 18% per annum or as per applicable law, calculated from the due date.
  7. Standard listing Owners have absolutely zero payment obligation to YeWalaGhar — under any circumstance.

14. Cancellation & Refund (Fast-Track Plan)

  1. Fast-Track is a success-based service — no brokerage is charged if the property is not rented.
  2. If any upfront payment has been collected under a specific Fast-Track variant, the applicable refund policy will be clearly communicated in writing at the time of opt-in.
  3. If the Owner withdraws from Fast-Track before a Tenant is introduced, no charges shall apply.
  4. If the Owner withdraws or cancels after a Tenant has been introduced and visits have been conducted, applicable charges may be levied at YeWalaGhar's discretion.
  5. Repeated unjustified cancellations by the Owner — after Tenant finalization or Agreement stage — may attract penalties and permanent listing suspension.

15. Payment Declaration

  1. All payments for any service, fee, brokerage, or transaction related to YeWalaGhar.com must be made only in favour of Grenoverse Multi Ventures LLP through official and authorized payment channels communicated by YeWalaGhar.
  2. YeWalaGhar.com and Grenoverse Multi Ventures LLP shall not be responsible for any payment made to any individual, team member, agent, broker, or third party who is not officially authorized in writing by Grenoverse Multi Ventures LLP.
  3. Owners are advised to always demand an official receipt or payment confirmation for any payment made toward YeWalaGhar services.

16. Illegal Activity & Criminal Conduct — Platform Disclaimer

  1. YeWalaGhar is a neutral, passive technology platform and has absolutely no control, knowledge, or oversight over activities conducted at any listed property.
  2. YeWalaGhar does not endorse, authorize, facilitate, encourage, or support any illegal, unlawful, immoral, or criminal activity at any listed property.
  3. The Owner is solely, fully, and exclusively responsible for ensuring that the property is not used for any illegal, unlawful, immoral, or criminal purpose — including but not limited to drug use or trafficking, human trafficking, prostitution, illegal gambling, terrorist activity, or any other offense under Indian law.
  4. In the event of any illegal activity at the property, YeWalaGhar shall bear absolutely no liability, responsibility, or culpability of any kind whatsoever.
  5. Any investigation, inquiry, FIR, legal proceeding, notice, or government action arising from illegal activities at the property shall be handled exclusively and solely by the Owner and the Tenant, without any involvement of YeWalaGhar.
  6. YeWalaGhar reserves the right to immediately and permanently delist any property found to be associated with illegal activities, without prior notice and without any obligation to the Owner.
  7. YeWalaGhar shall fully cooperate with law enforcement authorities, courts, and government agencies and may share Owner and Tenant information when legally required or compelled — this cooperation does not constitute any admission of wrongdoing by YeWalaGhar.
  8. The Owner agrees to fully indemnify and hold completely harmless YeWalaGhar, Grenoverse Multi Ventures LLP, and all its directors, officers, employees, and representatives from any legal proceedings, claims, penalties, damages, or costs arising from illegal or unlawful activities at the listed property.

17. WhatsApp Communication & Automated Messaging Consent

By listing a property on YeWalaGhar.com or interacting with our services through any channel, the Owner explicitly and voluntarily opts in to receive WhatsApp communications from YeWalaGhar.com.

17.1 Consent Declaration:

The Owner hereby gives free, specific, informed, unconditional, and unambiguous explicit consent to receive automated and manual WhatsApp messages, notifications, alerts, and communications sent by or on behalf of YeWalaGhar.com (Grenoverse Multi Ventures LLP) on their registered WhatsApp number.

17.2 Types of Communications:

Messages sent may include:

  • Tenant match alerts and profile sharing notifications
  • Site visit scheduling and confirmation messages
  • Listing status updates (active, paused, expired, Fast-Track)
  • Payment reminders and invoice notifications (Fast-Track Owners)
  • Platform service announcements and policy updates
  • Listing upgrade offers and promotional communications
  • Legal notices or compliance communications where required

17.3 Message Channels:

Communications may be delivered through:

  • WhatsApp Business API (Automated Messaging)
  • Manual WhatsApp messages from YeWalaGhar team members
  • Broadcast and bulk notifications relevant to property owners

17.4 Owner Responsibility:

The Owner acknowledges that messages will be sent to the WhatsApp number registered at the time of listing and it is the Owner's sole responsibility to keep this number updated with YeWalaGhar at all times.

17.5 Opt-Out:

The Owner may withdraw WhatsApp communication consent at any time by:

  • Sending a written request to privacy@yewalaghar.com
  • Replying "STOP" on any YeWalaGhar WhatsApp message

Post opt-out, critical service-related, legal, and payment communications may still be sent as per legal obligation and cannot be opted out of.

17.6 Non-Delivery:

YeWalaGhar shall not be responsible for non-delivery of messages due to the Owner's number being inactive, incorrect, blocked, or opted out of WhatsApp Business communications.

17.7 Legal Governance:

This consent is governed by the Information Technology Act, 2000, DPDP Act, 2023, and applicable TRAI regulations for business messaging in India.

17.8 WhatsApp Consent Checkbox (Mandatory at Listing):

I hereby give my free, specific, informed, and unambiguous consent to receive automated and manual WhatsApp messages, notifications, alerts, and updates from YeWalaGhar.com (Grenoverse Multi Ventures LLP) on my registered WhatsApp number for all service-related, listing-related, and platform-related communications. I understand I may opt out at any time by emailing privacy@yewalaghar.com or replying "STOP" on WhatsApp.

18. Content Accuracy & Intellectual Property

  1. All property photographs, videos, descriptions, and details uploaded by the Owner must be accurate, genuine, and legally owned or properly authorized for use by the Owner.
  2. The Owner confirms they have full right to use all uploaded content and that it does not violate any third-party copyright, privacy rights, or intellectual property rights.
  3. YeWalaGhar may use uploaded property content for platform display, digital marketing, social media promotion, and related promotional purposes without separate compensation or permission.
  4. The Owner is solely responsible for any legal claim, copyright infringement action, or penalty arising from inaccurate, misleading, or unauthorized content uploaded to the platform.
  5. YeWalaGhar reserves the right to edit, resize, or optimize uploaded content for platform display purposes without altering the fundamental nature of the content.

19. Force Majeure

  1. YeWalaGhar shall not be liable for any failure, delay, or disruption in services caused by events beyond its reasonable control, including but not limited to:
    • Natural disasters, floods, earthquakes, cyclones, or acts of God
    • Pandemic, epidemic, or public health emergencies declared by government
    • Government orders, lockdowns, curfews, or regulatory restrictions
    • Internet, server, or technology infrastructure failures
    • War, riots, civil unrest, strikes, or terrorist activities
    • Any other event beyond YeWalaGhar's reasonable control
  2. In such events, YeWalaGhar's obligations shall be suspended for the duration of the force majeure event without liability.
  3. Neither party shall claim compensation for losses arising from a force majeure event.
  4. YeWalaGhar will make reasonable efforts to resume services as soon as practically possible after a force majeure event.

20. Accuracy, Liability & Indemnity

  1. The Owner is solely, fully, and exclusively responsible for the legal status, physical condition, accuracy, and completeness of all property details provided on the platform.
  2. Any loss, dispute, legal action, or claim arising from false, incorrect, or misleading information provided by the Owner is the Owner's sole and exclusive responsibility.
  3. The Owner agrees to fully and unconditionally indemnify, defend, and hold harmless YeWalaGhar, Grenoverse Multi Ventures LLP, and all its directors, officers, employees, agents, and representatives against any and all claims, losses, damages, penalties, legal costs, and liabilities arising from:
    • Misrepresentation, fraud, or false statements by the Owner
    • False or unauthorized ownership declarations
    • Illegal activity at the listed property
    • Violation of society, RWA, or government regulations
    • Failure to conduct Police Verification
    • Breach of any term of this agreement
    • Any third-party claim related to the listed property
  4. YeWalaGhar acts only as a neutral facilitating platform and is not responsible for any ownership, structural, municipal, legal, financial, or regulatory matter related to the property.

21. Data & Privacy

  1. Owner personal data is collected and processed strictly for YeWalaGhar and Grenoverse Multi Ventures LLP service delivery, verification, and operational purposes only.
  2. Data may be shared with Tenants (limited profile), verification agencies, payment gateways, or legal and government authorities only when required by law or operational necessity.
  3. YeWalaGhar does not sell, trade, rent, or misuse Owner personal data under any circumstances.
  4. Data collection, processing, and retention is governed by YeWalaGhar's Privacy Policy for Owners (available separately on the platform) and the DPDP Act, 2023.
  5. Owners have the right to access, correct, and request deletion of their personal data as per the DPDP Act, 2023.
  6. For all privacy-related requests and grievances, Owners may contact: privacy@yewalaghar.com

22. Insurance & Safety

  1. Owners are strongly advised to maintain adequate property insurance covering structural damage, fire, theft, and third-party liability.
  2. Owners must ensure all safety compliance requirements — including fire safety, electrical safety, and structural safety — are met at all times.
  3. YeWalaGhar shall not be liable for any accidents, injuries, deaths, thefts, fire incidents, structural failures, or any third-party claims arising at or related to the property.

23. Limitation of Liability & Comprehensive Disclaimer

YeWalaGhar.com and Grenoverse Multi Ventures LLP act strictly as a neutral, passive, technology-based property listing and facilitation platform only.

To the maximum extent permitted by applicable law, YeWalaGhar shall not be responsible or liable — directly, indirectly, consequentially, or otherwise — for:

  • Any illegal, criminal, or unlawful activities conducted at the listed property
  • Any civil or criminal disputes, conflicts, or legal proceedings between Owner and Tenant
  • Any accidents, injuries, deaths, thefts, fire, or any other mishaps at or related to the property
  • Any property damage, structural failures, or maintenance deficiencies
  • Any misuse of the property or violation of local laws, society rules, RWA bye-laws, or government regulations
  • Any financial loss, business loss, rental loss, or consequential damages suffered by the Owner or any third party
  • Any Tenant misconduct, default, non-payment, fraud, or criminal behavior post-possession
  • Any failure, delay, or inadequacy of Police Verification or document authentication
  • Any dispute arising from society, RWA, or housing authority non-compliance
  • Any force majeure events as defined herein
  • Any inaccurate, outdated, or unauthorized content uploaded by the Owner
  • Any outcome of the rental relationship between Owner and Tenant post-facilitation

Maximum Liability Cap:

In any circumstance where YeWalaGhar is found liable by a court of competent jurisdiction, the maximum total liability of YeWalaGhar shall be strictly limited to the actual service fee received from the concerned Owner for the specific transaction in dispute. Under no circumstances shall YeWalaGhar be liable for punitive, consequential, indirect, or exemplary damages.

YeWalaGhar shall not be treated as a party to any rental agreement, dispute, claim, notice, or legal proceeding between the Owner and the Tenant. Any legal, financial, civil, or criminal consequences arising therefrom shall be handled exclusively between the Owner and the Tenant.

24. Governing Law & Dispute Resolution

  1. These Terms & Conditions are governed exclusively by the laws of India.
  2. The parties shall first attempt amicable resolution within 30 days of any dispute arising.
  3. If unresolved, all disputes shall be subject to the exclusive jurisdiction of competent courts in Greater Noida, Uttar Pradesh, India.
  4. Arbitration Option: Either party may opt for arbitration under the Arbitration and Conciliation Act, 1996, with the following terms:
    • Seat and Venue: Greater Noida, Uttar Pradesh, India
    • Language: English or Hindi
    • Number of Arbitrators: Sole Arbitrator mutually appointed
    • Interim Relief: Either party may approach competent courts for interim relief pending arbitration
  5. The costs of arbitration shall be shared equally unless otherwise awarded by the arbitrator.

25. Termination

  1. YeWalaGhar may immediately suspend or permanently terminate any listing or Owner account for:
    • Policy violations or breach of any term herein
    • Fraudulent misrepresentation or false ownership declaration
    • Association with illegal activity at the listed property
    • Repeated or confirmed anti-bypass attempts
    • Non-payment of Fast-Track brokerage post deal closure
    • Repeated unjustified cancellations or misconduct
  2. Termination of listing or account does not waive any outstanding brokerage, indemnity, or legal obligations of the Owner.
  3. YeWalaGhar reserves the right to permanently ban any Owner found guilty of fraud, misrepresentation, or criminal conduct without any prior notice or compensation.

26. Severability

If any clause or provision of these Terms & Conditions is found invalid, unlawful, or unenforceable by a court of competent jurisdiction, such clause shall be severed and the remaining provisions shall continue to be fully valid and enforceable in their entirety.

27. Entire Agreement

These Terms & Conditions, together with the YeWalaGhar Privacy Policy for Owners and Fast-Track Service Terms (where applicable), constitute the entire agreement between the Owner and YeWalaGhar regarding the use of platform services and supersede all prior agreements, representations, understandings, or communications — whether oral or written.

28. Amendments

  1. YeWalaGhar reserves the right to amend, update, or modify these Terms & Conditions at any time with reasonable notice via website update.
  2. Material changes will be communicated to registered Owners via WhatsApp or email.
  3. Continued use of the platform after any amendment constitutes full and unconditional acceptance of the revised Terms & Conditions.
  4. Previous versions of these Terms & Conditions are available on request for reference purposes.

29. Digital Acceptance & Consent Records

29.1 Website Checkbox (Mandatory — Listing Cannot Be Submitted Without This):

I confirm that I am the lawful owner / duly authorized representative of the listed property. The property is legally mine, free from all disputes, and rental is permitted by the applicable society or RWA. I have read, fully understood, and unconditionally agree to all YeWalaGhar Owner Terms & Conditions (Version 2.0, dated 01/01/2026), including the WhatsApp communication consent clause. I understand that YeWalaGhar is a neutral platform and shall not be liable for any disputes, illegal activities, accidents, or consequences arising at or related to the property.

29.2 WhatsApp Consent:

Replying "YES, I AGREE" on YeWalaGhar's official WhatsApp Business number constitutes legally binding secondary consent — including consent for all future WhatsApp communications. This serves as secondary evidence; primary acceptance is through the website checkbox.

29.3 Consent Records:

YeWalaGhar maintains digital consent records including:

  • Timestamp of acceptance
  • IP address at time of submission
  • Registered mobile number
  • Terms & Conditions version accepted
  • Checkbox text version
  • Platform and device information

These records shall constitute valid legal evidence under the Information Technology Act, 2000 and Indian Contract Act, 1872.
